Safety at height is a hotly debated topic, especially due to the extensive regulatory landscape that surrounds it.
Legislative Decree 81/2008, as amended, introduced the nationwide requirement to install collective or individual protection devices where there is a risk of falling from a height. Several regions have chosen to supplement the national law, which is already binding regardless of these regional enhancements, by further addressing practical aspects (access, routes, etc.) or by mandating the installation of lifelines during renovation work and on new buildings. This is to ensure the safety of all workers accessing, transiting, and working on roofs for future maintenance.
Condominiums are also subject to obligations and responsibilities governed by the Consolidated Law on Safety, which directly involve administrators.
Whenever ordinary or extraordinary maintenance is carried out in a condominium,
the administrator is in fact directly responsible for the safety of the workers.
As regulated by Articles 15 and 90 of Legislative Decree 81/2008 and subsequent amendments, the employer, and in this case the administrator, has the duty to provide adequate protective measures in the event of access to the roof and is directly responsible in the event of an accident due to a fall from a height in cases where collective or individual protective measures have not been provided (Articles 111 and 115 of Legislative Decree 81/2008).
